2. Personal data we collect

We may process the following categories of data, depending on how you use the website:

  • Identification and contact data: name, email, phone (if provided), company/role (if provided).

  • Application/diagnostic data: information you include in the form (e.g. project status, objectives, etc.).

  • Blog comment data: name/alias, email (if requested), comment content and technical metadata (e.g. IP) when necessary to prevent spam/abusive use.

  • Billing and transaction data (if you contract services): data needed to invoice, receipts and payment status (we do not store full card data; it is handled by the payment provider).

  • Technical data: essential basic browsing information (technical cookies and security logs).

3. Purposes, legal basis and retention

A) Contact form

  • Purpose: respond to requests for information, questions or inquiries.

  • Legal basis: user consent when submitting the form.

  • Retention: until the request is resolved and, at most, 12 months if it does not lead to a contractual relationship.

B) Application/diagnostic form

  • Purpose: evaluate your application, contact you, prepare a proposal and manage the pre-contractual relationship.

  • Legal basis: consent and/or implementation of pre-contractual measures at the request of the data subject.

  • Retention: until the process ends and, at most, 12 months if no contract is signed.

C) Blog comments

  • Purpose: publish and moderate comments, prevent spam/abuse and maintain site security.

  • Legal basis: consent (when submitting the comment) and/or legitimate interest (security and moderation).

  • Retention: while the comment remains published or until you request its deletion, unless a legal obligation applies.

D) Provision of services (Downloadable tools, Programs, Community, Mentoring/advisory)

  • Purpose: manage contracting, service delivery, support, operational communications, administrative management and invoicing.

  • Legal basis: performance of a contract.

  • Retention: during the contractual relationship and, thereafter, for the applicable legal periods (e.g. tax/accounting).

E) Commercial communications (if enabled and you accept)

  • Purpose: send you informative or commercial communications related to Tuson Advisory by electronic means.

  • Legal basis: consent (specific checkbox).

  • Retention: until you withdraw consent (you can unsubscribe at any time).

4. Obligation to provide your data

Providing personal data may require a minimum age of 14 years or, where applicable, sufficient legal capacity to contract.

The data requested is that which is necessary to manage your requests and/or provide the services. If you do not provide it, we may not be able to assist you properly.

5. Recipients and data processors

Your data will not be transferred to third parties, except where legally required. However, in order to operate, we may use providers that process data on behalf of the controller (data processors), for example:

  • HubSpot (CRM and email marketing)

  • Stripe (payment processing)

  • WordPress (website manager, depending on hosting configuration)

  • Namecheap (domain/infrastructure depending on contracted services)

  • Hosting providers (depending on the plan contracted with Namecheap or another provider).

6. International transfers

Some providers may be located outside the European Economic Area. In such cases, transfers will be carried out with adequate safeguards (e.g. Data Privacy Framework and/or standard contractual clauses, as appropriate).

  • HubSpot is listed as a participant in the EU-U.S. Data Privacy Framework.

  • Stripe is listed as a participant in the EU-U.S. Data Privacy Framework and publishes its DPF policy.

7. Rights of data subjects

You can exercise your rights of:

  • Access, rectification, erasure, objection, restriction, portability.

  • Withdraw consent at any time (without affecting prior processing).

How to exercise them: by writing to fee@tusondavisory.com with the subject “Personal Data”, indicating the right you wish to exercise and the data affected.

You also have the right to file a complaint with the Spanish Data Protection Agency (AEPD).

8. Security of your data

We have adopted reasonable technical and organisational measures to protect your data against loss, unauthorised access, alteration or disclosure.

9. Data accuracy and updates

The user warrants that the data provided is accurate and undertakes to notify us of any changes.

10. Third-party links

We are not responsible for the privacy policies of third parties you may access through links on our website.

11. Changes to the policy

This Policy may be modified to adapt to changes in the website or legislative changes. We recommend reviewing it whenever you provide us with personal data.


Terms and Conditions (Use and Contracting)

2. Purpose and scope

These conditions govern:

  • Access to and use of the TusonAdvisory.com website, and

  • The contracting of products/services offered (e.g.  Mentoring/advisory).

By browsing or contracting, you accept these conditions.

3. Conditions of use of the website

The user undertakes to:

  • Use the website lawfully and respectfully.

  • Not carry out actions that damage, overload or prevent the operation of the site.

  • Not introduce malware or make unauthorised access attempts.

  • Not use the contents for illegal purposes or infringe third-party rights.

We may restrict or block access in cases of abusive use or use contrary to these conditions.

4. Intellectual and industrial property

All content (texts, methodology, materials, brand, design, etc.) belongs to Tuson Advisory, S.L. or to third-party licensors.

Personal and internal use of purchased materials is permitted. Reproduction, distribution, public communication, resale, transfer or making available to third parties without express authorisation is prohibited.

5. Services offered and availability

Mentoring/advisory (sessions or packages).

Community/group sessions.

Downloadable tools.

Unless otherwise indicated on the product page, places may be subject to availability. 

We reserve the right to modify, suspend or withdraw products/services, informing about it to the extent possible.

6. Purchase process, price and taxes

  • Prices are shown in EUR and include VAT, unless otherwise indicated.

  • Payment is made via Stripe.

  • After payment, you will receive confirmation by email and/or access to the service as indicated.

7. Delivery and access

  • For digital services (materials, access to resources), access is normally provided by email or through the indicated platform.

  • For session-based services (mentoring), coordination will be carried out through the channels communicated.

  • In the case of Community, access and operating rules will be detailed on the product page and/or during onboarding.

8. Participation rules (Community / group sessions)

If there is Community or group spaces, the user undertakes to:

  • Maintain a respectful and professional tone.

  • Not share illegal or offensive content or content that breaches third-party confidentiality.

  • Not engage in spam or unauthorised promotions.

  • Respect intellectual property and not share materials outside the environment.

Non-compliance may result in suspension or expulsion without the right to a refund in serious cases.

9. Right of withdrawal and refunds

If you contract as a consumer in the EU, you have 14 calendar days to withdraw, provided that the service has not yet started or that digital content has not been consumed.

To exercise the right of withdrawal, write to fee@tusondavisory.com indicating your unequivocal decision and the details of your purchase.

Important (digital content/services): if access to digital content or the service begins before the 14 days end, we may request your express consent and acknowledgement that, once started, you may lose the right of withdrawal under the legally applicable terms.

10. Liability and disclaimer of warranties

Tuson Advisory offers training, tools and advisory. We do not guarantee results (which depend on multiple factors beyond our control).

We will not be liable for service interruptions due to force majeure, third-party incidents (e.g. payment/hosting providers) or necessary maintenance.

In no case, when legally applicable, shall total liability exceed the amount actually paid by the user for the service that gave rise to the claim.

11. Data protection

The processing of personal data is governed by the Privacy Policy published on the website.

12. Modifications

We may update these conditions due to legal changes or service improvements. If the changes materially affect contracts in progress, we will communicate this through reasonable means.

13. Applicable law and jurisdiction

These conditions are governed by Spanish law. For any dispute, the parties submit to the Courts and Tribunals of Málaga, unless a mandatory rule provides otherwise.
